1. Service Overview
Momently is a private, offline-first emotional journaling app that helps users capture daily moments with photos and short videos, track their mood, write thoughts and voice notes, and view a unified personal timeline. All data is stored exclusively on the user's device. Momently does not provide medical, psychological, or therapeutic advice.
2. Eligibility and Use
By using Momently, you confirm that you are legally able to enter into these Terms and that you will use the app in accordance with applicable laws. Momently is intended for personal, non-commercial use as a private journaling and self-reflection tool.
3. Acceptable Use
You agree not to misuse the service. Prohibited behavior includes:
- Attempting to reverse engineer, decompile, or extract source code from the app
- Using the app in a manner that violates applicable laws or regulations
- Redistributing, sublicensing, or commercially exploiting the app or its content
- Attempting to bypass biometric lock or security features
4. Your Content
All content you create in Momently - photos, videos, voice notes, mood entries, and written thoughts - is yours. We never access, view, copy, or transmit your content. Your content is stored locally on your device and is not uploaded to any server.
You are solely responsible for the content you create and store within the app. Momently provides the container; what you put inside it is yours alone.
5. Device Permissions
Momently may request access to your device's camera, photo library, microphone, notifications, and biometric authentication. These permissions are used exclusively for the app's core features and can be revoked at any time from your device Settings. Denying a permission disables the related feature but does not affect the rest of the app.
6. Notifications
If you enable daily reminders, Momently sends local notifications at your preferred time. These notifications are scheduled and delivered entirely on-device. Delivery timing may vary based on device state, Focus modes, or operating system behavior.
7. Data and Deletion
Since all data is stored locally, you have complete control over it. You can export all data as a JSON file, delete individual entries, or erase everything from the Settings screen. Uninstalling the app permanently removes all data. We have no ability to recover deleted data because we never had it.
8. Intellectual Property
The app, including its software, interface, mascot character, branding, design elements, and related materials, is owned by Momently or its licensors and is protected by applicable intellectual property laws. Except for limited personal use, no rights are granted to copy, redistribute, or create derivative works from the app.
9. Mental Health Disclaimer
Momently is a self-reflection and journaling tool, not a mental health service. The mood tracking, thought journaling, and voice note features are designed to support personal awareness and emotional expression. They are not a substitute for professional mental health care, therapy, or crisis intervention. If you are in distress, please contact a qualified professional or crisis helpline.
10. Disclaimer
Momently is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted performance.
11. Limitation of Liability
To the maximum extent permitted by law, Momently and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data or service interruptions arising from your use of the app.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, the updated version will be reflected by the "Last updated" date. Continued use of the app after updated Terms take effect means you accept the revised Terms.
